I had a cup of coffee with a new driver who hired on with an intermodal company recently and he opened up to me about how he felt like he "couldn't last".
When I asked him why he told me the boss of that company didn't care about log book rules and would pressure the drivers into changing the logs to make them legal, while running the drivers sometimes almost around the clock and starting them again with very little rest, only a couple of hours from the time they got done!
This really got my blood pressure up. Well, I had a nice little talk to him about how I had personally run across such people in some of the past jobs I have had. So here is my advice on how to deal with this if you find yourself in this situation.
First and foremost know this, that if you are ever involved in an accident where there are injuries or fatalities, or property damages, anything that involves money having to be paid out, there will be an investigation.
Your log book will be checked out, also your companies logs (which you signed) will be compared to your personal book you turned over at the accident. You better hope they match up, and not only that, any fuel you have purchased will have traceable times to be checked out, any I-Pass or EZ Pass you have used, any toll receipts, any expenses at all that were turned in, in the past, will be matched to where you say you were on those logs. If you have been DOT'd that will show up, If you have used a Pre-Pass to go around an open scale.... etc.. All these things have traceable "time stamps".
And guess who gets hung out to dry if these things don't match. Let me clue you in on something, your boss who previously pressured you into running for him day and night, with no regard to your personal safety, driven by greed in the first place, will stand in court with his hand on the Holy Bible and swear to God and men that he had no idea that you were turning in false logs.
And even if you can prove he did know, you're still the guy who did it! That wont take your manslaughter charge away.
So what to do? It's really very simple.. just run a legal log book. No matter what anyone says or how anyone makes you feel, the law is on your side here, and these pig bosses who risk your life to make them rich all know it.
Now they probably will try to retaliate by giving you the worst loads possible for a time, and God help you if you are a percentage driver, expect to see a lot of traffic for very little pay for a while, but if this keeps up for more then a week or so, its time to drop a dime, and you need to have the backbone to let your bosses know it.
Keep records of everything. Record everything wherever possible. Do this to protect yourself. Don't allow yourself to be bullied into breaking the law, where the consequences are so high you will be taken away from the family you are working to provide for in the first place. If it comes right down to it you can always call DOT and have a nice little chat with them, let them come down and pay a couple of visits to the jerk who is doing this to you, and see if he doesn't stop screwing you around. You'll be surprised at his change of attitude toward you, as fear builds up of being forcefully deprived of the money he so faithfully worships.
Of course this should be a last resort. Like I said, before you go to these extremes just let him know you'll be following the law where your concerned and you wont be changing or handing in any phoney logs. Get your rest, you need it to do your job safely. Those aren't just pretty words, they are facts.
Now do your jobs with honesty, and by the integrity of your hearts provide for your families. Aim to please God rather than men in all that you do.
